I sold a project reverse smoker....buyer wants $ back...wtf?

I sold a bbq/smoker through craigslist. the buyer sent a FRIEND to pick it up and paid me $200 which was less than I wanted. I handed the $ to my father who i owe $ too. few hours later i get a call from the buyer stating he dosnt want it because its too small and has rust and wants a refund. I explained that there are several pictures on the craigslist add and it says its a project. He said he wants to come talk to me personally. I did some research and it says I am not obligated to refund his money. I sold it because I needed money to pay my father. Now that he wants it back Im suposed to pull $200 from my pocket and "buy" the smoker back? Im not a d*ck, but i feel he has buyers remorse and thats not my problem. I told him thursday he can drop it off here, but I have a nerve to tell him to pound salt. what do you think?

If he wants to drop it off fine...I wouldn't give his money back. Once the deal is done its done, assuming there is no contract an item is bought "as is".

Boy, what a tough call.

I am not 100% sure what I would do in this situation. Bad part is that there was a third party involved.

I think that I would probably have to try and scrounge up the 200 and bite the bullet, If you can swing it then there it way more money to be had from that smoker, even as it sits. Specially if it has the rf plate in it already.

But thats just me. May think different if I was in your shoes.

Tell him he's SOL. He should have come and picked it up, not his friend. You can see by the pics that it has rust. He bought it "as is"

ya know i was going to take it back, then i explained that the money went to my father. he said he was going to ask my father for the money and that he would understand. i told my father what he said and he laughed. then when i told the guy that my dad didnt care he wanted to come talk to me personally.

tommorow i am going to tell him that i spoke to my father, who is a retired cop and he informed me that i have no obligation to refund the money. also if he continues to contact me via telephone or at my home, or anyway that would be harrasment.

We had a guy at work sell a truck to someone, the guy wrote a check and drove it home. After a day or so the guy realized it was a real POS and even had a blown engine, so he put a stop payment on the check and returned the truck without even talking about the deal...of course the guy at work took him to court over it all, and came out on top. Obviously 200 isn't worth going to court over but I would still stand my ground on sold is sold.

First warning to the buyer is "asking $600 as is"----- AS IS.....
you can see the rust on it, you can see it says "project is almost complete"
the buyer does not deserve his money back... :beer:

i agree, but its tough....i live at my fathers. he has my address. my father does not want this person comming here or anything if i choose not to buy back the smoker. should i tell him tomm i just left the sherriffs office and gave them his first name and telephone number and explained that he is harrasing me, just to get him to give up? i cant have him here, my dad will be pissed. he lives about 1 hour away, so thats good, but i feel i need to give him a hint that if he persists law enforcement will be contacting him. i hate to do it, but im not responsible for his buyers remorse. and i cant bring drama to the house.

the best scenario is to tell you would be happy to grind the rust off for him but you can not give him his money back.

The fact that you gave the money to your father is totally irrelevant to the case. The buyer either has the right to return the item or he doesnt. He has no business with your father, and you can tell him it is harassment if he bothers him and that you will persue legal actions if he does.
Furthermore the person that picked it up paid you, i would think that if he thought the item is ok your solid.

Besides this all he is a fu**tard, how the heck can you not see that this has rust from the pictures! And 200 bucks seems like a nice price, he could finish it for not to much money.

I can tell yuo the way I roll is.... if you come to my house causes problems with my family, YOU ARE SUBJECT TO GETTING YOUR TAIL TORE OUT OF FRAME!!!!!!!!!!!!!!!!!!!!!! IF I had the money I might give it back i might not depending on your attitude, but do not come at me in a disrespectful way, i dont play that game. In the picture it is clear that it is what it is

:yth: :yth: .....its not your fault he didn't show up in person....and it went from 600.00 to 400.00? and by "rust" I am assuming its the normal surface rust that comes from an unfinished project? I would tell him to get bent....and at very least give him back 150.. and tell him the 50.00 covers your time that has been wasted!!! If your state allows a open carry law on hand guns, I would be wearing the biggest one I had when he does show up...... X(

I once sold a boat and the buyer after using it once he called me and wanted to renegotiate on the price. I told him that we had a deal and he was out of luck. He called me several times after that I finally told him to pound sand. HOLD your ground people need to know that when you buy something it is sold. Tell him he can sell it for scrap if he does not like it.

I contacted the local law and explained the situation. They said I don't have to refund money. I contacted him and told him I contacted law and he said his dad and brother are attorneys and I don't wanna go to court for $200. I told him it won't hold up in court and if he wants we can meet with an officer so they can explain it to him. He says he's coming tommoorow even though I told him he's not welcome. ..............wtf.......I don't need him coming to house and miss my dad off. Cops said if he shows up call them but I hope it dost go that far......aughghgh

You're getting a little worked up here, bud. Take a deep breath and maybe a Xanex. I just personally dealt with a situation where some d bag was stalking my cousin, here is my advice.
1. Don't threaten the guy with the cops. Okay too late for that.
2. If the guy shows up uninvited call the cops. Refuse to go outside and speak to him alone, wait until the cops arrive.
3. Document everything this clown does and says. Dates and times, phone calls, emails, text messages, etc.
4. The guy is not going to sue you for $200, it will cost him more than that to file the lawsuit. I don't know about Florida specifically, but in small claims that i have dealt with lawyers were neither required nor allowed. We are talking about $200 bucks, not an episode of Law and Order.
5. If your old man gets pi*sed when/if guy shows up, all you have to do is say he's trespassing. You told him not to come.
6. Even if you gave the guy his money back you could probably scrap the steel for $200 if you need the money badly. Not the ideal use of the work you've done, but I'm not sure what your financial situation is.

I can assure you that if he has done everything you said he did - he is definitely NOT a lawyer.

Talk's cheap and he's in the intimidation game.

This type of personality is best fought with over-the-top kindness - it drives them nuts to the point they can't even think ...

Hey guys. I had a officer call him today. the officer explained that the craigslist post was descriptive and he should have picked the item up himself. The guy didnt believe him. he started asking for his bardge # and name..... I dont think he will be comming by. I told my father that a officer contacted him and i have my fathers support. I will call the cops on his ass if i have to. Thank you all for your advice. i was acually thinking of giving this guy money before i came on here and saw all the posts that said he was in the wrong and tell him to pound sand.

i might take the $200 and start a "real"/better reverse smoker build. :beer:
